Policy Statement by Yavapai College Registered Sex Offenders

In accordance to the “Campus Sex Crimes Prevention Act” of 2000, which amends the Jacob Wetterling Crimes Against Children and Sexually Violent Offenders Registration Act, the Jeanne Clery Act and the Family Educational Rights and Privacy Act of 1974, the Yavapai College Police Department is providing a link to the Arizona Department of Public Safety Registered Sex Offender web page.

This act requires institutions of higher education to issue a statement advising the campus community where law enforcement information provided by a State concerning registered sex offenders may be obtained.

It also requires sex offenders already required to register in a State to provide notice to each institution of higher education in that State at which the person is employed, with or without compensation, at a public or private institution of postsecondary education or carries a vocation at such institution.

Yavapai College Registered Sex Offender Notification
Procedure

While institutions are required to inform the campus community where sex offender information can be accessed, the institution is not required to disseminate sex offender information throughout the community. Clery Act Requirements.

Registered Sex Offenders Yavapai College Procedures

Yavapai College (YC) is committed to providing a safe learning and working environment. In accordance with Arizona law (A.R.S. 13-3826), YC has instituted a registered sex offender (RSO) notification process for the safety and well being of everyone attending or working at the College. Several individuals and departments will be involved in the protocol of advisement and notification including the Dean of Student Affairs, the Assistant Deans of Student Affairs, the Director of Campus Police, the Registrar, involved college faculty, and other student affairs staff on a need-to-know basis.

A. Upon notification of a RSO residing near YC, or attending classes or any college activity (includes all YC locations in Yavapai County), the following procedures for notification will be followed:

1. Advise the Director of Campus Police if notification was not made through the College Police Department.

2. The Director of Campus Police, or designee, will initially notify the Dean of Student Affairs, the Assistant Dean of Student Affairs (Prescott and/or Verde Valley), the Campus Dean, and the Registrar by email. Information and documents received from the Yavapai County Sheriff’s Office about the RSO will be provided.

B. Once the initial notification has been completed, the following procedures will be followed by each department:

1. Registrar:

a. The RSO student record will receive a special “Hold Code”.

b. A class roster check will be completed to insure none of the students are under the age of 18. This roster check will then be forwarded to the Assistant Dean of Student Affairs.

2. Assistant Dean of Student Affairs or designee:

a. Consult with the Campus Police officials on the RSO case information, court restrictions and probation requirements as they pertain to their attendance at YC.

b. Meet with the RSO and outline specific requirements, and determine restrictions and compliance parameters as they apply to their attendance and while they are on YC property.

c. Either provide or arrange academic advising that addresses the attendance procedures and restrictions.

d. Complete a letter to the RSO documenting the specific requirements and restrictions while attending YC.

e. Notify faculty by letter and in person as needed, as to the RSO’s attendance in their class.

f. Maintain a case management approach as to future contact with the RSO.

3. Director of Campus Police or designee:

a. Place a RSO link to AZSexOffender.com on the Campus Police web-site if the RSO has a risk level of 2 or 3.

b. Meet with the RSO.

c. Maintain a file on the RSO.

d. Insure all community notification is completed in accordance with Arizona and Federal law and the Clery Act.

Yavapai College Police Procedure

REGISTERED SEX OFFENDER NOTIFICATION IN ACCORDANCE WITH A.R.S. 13-3826 COMMUNITY NOTIFICATION GUIDELINES

A. Upon notification of a registered sex offender residing at Yavapai Community College, or attending classes or any college activity (includes allYavapai College locations in Yavapai County), the following procedures for notification will be followed:

1. The Dean of Student Affairs and the Assistant Dean of Student Affairs will be notified and be given complete information of the registered sex offender, including their name, date of birth, address, risk level, brief summation of sex offense, a bulletin if available, and the name of the law enforcement agency and individual who notified Campus Police.

B. Dissemination of information will be completed in accordance with Arizona and Federal law and the Clery Act, as follows:

LEVELS 0-1 (Low Risk)

1. A photograph and all information about the sex offender will be maintained at the Campus Police Department.

LEVEL 2 (Intermediate Risk)

1. A photograph and all information about the sex offender will be maintained at the Campus Police Department.

2. The College Police Department’s web-site will provide the RSO’s first and last name and a link to the State of Arizona Sex Offenders web-site

3. When notified by an outside police department that a RSO resides within ¼ mile of the campus/site, notification, in accordance with existing laws of the respective YC campus/site, will be completed.

a. Notification procedures for Residence Hall students:

1. Contact the Residence Hall Director, in person, before distributing bulletins.

2. Door-to-door contact by a Campus Police Officer. The Police Officer will note if residents were personally contacted or if a bulletin was left.

3. Post bulletin, approved by the Hall Director, in a central gathering area of the Residence Halls.

b. Notification procedures for YC employees:

1. News Flash will be sent by the Director of Campus Police to all employees of the specific campus/site.

2. News Flash will provide the RSO’s first and last name and a link to AZSexOffender.com

3. Further notification will be made if deemed necessary by the Director of Campus Police.

LEVEL 3 (High Risk)

1. Complete all Level 2 procedures.

2. When appropriate, provide bulletin, approved by the Director of Campus Police, to the college newspaper for publishing.
